My privacy policy is simply stated: I maintain the confidentiality of any and all information that you voluntarily make available to me when you use the Site, or when you call me by phone, or send me a fax, or email me directly, unless you give me authority to share such information with others or unless I am compelled either by court order or by provisions of the Maine Bar Rules to disclose it. [Examples of when the Maine Bar Rules may require disclosure of information are given below.] "Information that may personally identify you." Information that may personally identify you refers to any information that identifies or can be used to identify, contact, or locate you, including, but not limited to, your name, your address, your phone or fax number(s), your email address, any of your financial information, including any credit card or bank account numbers, or your social security number. Information that may personally identify you does not include information that is collected by my Site server logs: for instance, the Internet Protocol (IP) address of site visitors or the web address of a third-party who may have referred any visitor to the Site. What information that may personally identify you is collected? Besides the non-personally identifying information collected by my Site server logs, I only collect personal information from you that you voluntarily provide to me when you (1) use one of my web forms to request information or services or ask a question; (2) contact me by phone, fax or email; or (3) send me information by letter or public carrier. Such information may include your name, address, phone number, and email address; your marital and family status; your employment or business status; your financial information and the nature your question or request. Who is actually collecting this information? I am the only person collecting this information and only when you voluntarily provide it to me. I do have products available for sale online. I use PayPal® as a third-party payment processor. If you purchase any of my products, you may be required to provide information that may personally identify you to PayPal®. When this occurs, PayPal® will share with me your name and contact information, what product(s) you purchased, and the price you paid, but will not share with me your credit card number or bank account information. PayPal® maintains its own Privacy Policy, over which I have no control. If you use PayPal® or any other website, I recommend that you read that site's Privacy Policy to make sure you can accept its terms. How does the Site use information that may personally identify you? You may use the forms on the Site to request information or services or ask me a legal question. When you do that, you will be providing me with information that may personally identify you. None of that information is stored on the Site. I use any of the information that I receive from you to fulfill information or legal service requests or answer your question(s). Depending on the information that you provide, I will email or call you in response to your specific inquiries, or to provide requested information. With whom may the information be shared? I maintain your confidentiality. I do not share information that may personally identify you with any outside person or entity except (1) when you have engaged my services as part of the attorney-client relationship and the nature of the services I am providing to you requires that I share such information with others, or (2) I am required by a Court order or the Maine Bar Rules to disclose such information. How is information that may personally identify you stored? No information that may perssonally identify you is stored at the Site. Any such information entered by you at the Site via one of my web forms is transmitted to my password protected web-based email accout. What choices are available to you regarding collection, use and distribution of the information? I do not distribute the information to third parties. I do not make unsolicited contact with Visitors of the Site. Visitors and Potential Clients may opt out of being contacted by me by responding to emails as instructed, or by contacting me at johngearyATjohngearylawDOTcom. Are Cookies Used on the Site? No. How does www.JohnGearyLaw.com use login information? At this time, there is no log-in area of the Site. What partners or service providers have access to information that may personally identify you on the Site? I have no partners and do not share information that may personally identify you with third-parties except as stated above. I use PayPal® as a service provider to act as a funds collection provider if a Client or Pontential Client wishes to pay for legal or related services with a credit card. PayPal® uses a secure, encrypted server. When PayPal's® services are used by a Client or Potential Client from the Site, I do not obtain any credit card or bank account related information. Information transmitted to PayPal® is not collected by the Site nor does PayPal® share that information with me. I am only notified that the Client or Potential Client has made a payment to my account and the date and amount of the payment, and any additional information that the Client or Potential Client has specifically addressed to me at the time payment is made. Disclosure of information that may personally identify you to comply with law. I will only disclose information that may personally identify you in order to comply with a court order or to satisfy my ethical obligations as established by the Bar Rules of the State of Maine. However, most such information is privileged information and I will vigorously defend against its release to the extent that such information is deemed privileged by the Maine Bar Rules and the Maine Rules of Evidence, as those rules have been interpreted by the Law Court of the State of Maine. Examples of information that is deemed not to be privileged are these: information from a person which makes clear that the person intends to commit violence against another person, or intends to commit a crime, or intends to commit perjury or other fraud against a court. How does the Site keep information that may personally identify you secure? No information that may personally identify you is stored on the Site. Your use of one of my contact forms delivers any information that may personally identify you to my web-based email account, which is password protected. No one else has authorized access to the information. It is not shared with any third-parties. At the time that a person clicks the "Submit" button respecting the web forms on the Site, the information submitted is encryted so that if it is intercepted, it cannot be read. How can you correct any inaccuracies in information that has been submitted from the Site? Visitors and Clients or Potential clients may contact me to update information about themselves or to correct any inaccuracies by emailing me at johngearyATjohngearylawDOTcom or by contacting me by phone. Can you delete or deactivate information that may personally identify you collected by the Site? The Site does not store information that may personally identify you. What happens if the Privacy Policy Changes? I will let my Visitors and Clients or Potential Clients know about changes to this privacy policy by posting such changes on the Site. Links: I provide hyperlinks on the Site that point to third-party websites for informational purposes as a service to my visitors. I do not necessarily endorse the information you may find on any of those pages. The nature of hyperlinks is such that if you click on a hyperlink, your web browser transports you to the web page underlying the link. Some hyperlinks on my Site link to other pages of my Site. However, some hyperlinks on my Site are links to third-party websites over which I have no control, and which probably have their own Privacy Policies which may differ from mine. I highly recommend that you read the Privacy Policy of any website that you visit, including the websites that you may reach by clicking any hyperlinks on the Site. Please understand that when you click on one of these links, you are moving to another web site. How does the Site deal with information relating to children? My services are not directed to children and I do not expect that children will be submitting information through the Site. I do not intentionally or knowingly collect information from children. Any information that I may collect about children is supplied by that child's parent or guardian. |
