"Reciprocal" wills for a married couple are separate wills declared by each spouse whereby each leaves the entire estate to the other spouse and each makes the same provisions for their child(ren) as the successor beneficiaries to provide for their child(ren) when the survivor of the couple dies.
While generally used by couples who each are the biological or adoptived parents of their child(ren), reciprocal wills can also be used by couples when either is the step-parent of one or more of their child(ren). Use of this form contemplates reciprocal wills in which all children of the couple, whether biological child(ren) or step-child(ren), will receive equal shares of the estate when the survivor of the couple dies. [Please note that unless a separate contract exists between the couple to the contrary, the surviving spouse is legally free to modify the provisions of his or her will].
The term "Testator" in the form below means the person who is declaring the Last Will and Testament.
