Here's how it works:

Your lender will require a lender’s policy of title insurance to protect its mortgage and you will be required to pay the premium.

Before a title insurance policy can be issued, an attorney must certify good and marketable title to the property. If you defer to your lender to choose the attorney (or title company) that will perform the title search and issue the lender’s title insurance policy, you will be required to pay for those services also.

Knowing your rights will allow you to save money.

Where your savings will come from:

Title companies usually charge around $275 (or more) for the title search.  The title insurance premium is an extra charge to you. 

When an individual title insurance “agent” (like me) or a title company acting as a title insurance “agency” issues a title insurance policy, the agent or agency earns a commission on the premium amount.  That commission averages about 70% of the actual premium paid.

The title company will charge you its standard rate for the title search and will charge you the standard title insurance premium.  

But when you exercise your right to choose me to search your title and issue the lender's title insurance policy, I will use the commission I earn for issuing the title insurance policy to off-set the fee for the title search.  And I will match any title company's title search fee.

Here's a very simple example of how I save borrowers real money:

Say you are borrowing $200,000.00.  You will pay $400.00 for the lender's policy of title insurance with Secondary Market and Environmental Lien Endorsements.  The average commission to the agent or agency producing the policy is $280.00.  If the title company your lender assigns to close your loan charges $275.00 for a title search (and you let that title company perform the title services), you will pay a combined total of $675.00.

But, if you exercise your right to choose me to perform these title services, you will only pay $400.00.

Since the commission I will receive for producing the lender's title insurance policy ($280.00) exceeds the cost you would have paid the title company for the title search, I will off-set the full cost of the title search, which translates to real savings of $275.00 for you.
